2. No Guarantee of Delivery

While we strive to ensure timely delivery of all SOS alerts, Spice Holdings LLC makes no guarantee that alerts will be delivered, received, or acted upon. Message delivery depends on third-party services including but not limited to email providers, telecommunications networks, internet connectivity, and device availability. Network outages, server failures, spam filters, device settings, or other technical issues beyond our control may prevent or delay message delivery.

3. Not a Replacement for Emergency Services

Instant Alerts is not a replacement for official emergency services. In the event of a life-threatening emergency, users and recipients should always contact their local emergency services (such as 911, 999, 112, or equivalent) directly. The Service is intended as a supplementary communication tool only and should not be relied upon as a primary means of emergency response.

4. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Spice Holdings LLC, its officers, directors, employees, agents, affiliates, or contractors be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, personal injury, loss of life, property damage, loss of data, or any other loss or damage arising out of or in connection with:

• The use or inability to use the Service
• Any failure, delay, or error in the transmission or delivery of SOS alerts
• Reliance on any information provided through the Service
• Any action or inaction taken by emergency contacts or third parties in response to an alert
• Unauthorized access to or alteration of user data or transmissions
• Any other matter relating to the Service

5. User Responsibility

Users are solely responsible for:

• Maintaining accurate and up-to-date emergency contact information
• Ensuring their device has adequate battery power, internet connectivity, and location services enabled
• Verifying that their emergency contacts are willing and able to receive and respond to SOS alerts
• Understanding the limitations of the Service as outlined in this disclaimer
• Contacting official emergency services directly in life-threatening situations

6. Third-Party Services

The Service relies on third-party infrastructure including email delivery services, hosting providers, and telecommunications networks. Spice Holdings LLC is not responsible for the availability, reliability, or performance of any third-party services, nor for any damages resulting from their failure.

7. GPS and Location Data

Location data provided through the Service is dependent on device GPS hardware, satellite availability, and environmental conditions. GPS coordinates may be inaccurate, delayed, or unavailable. Users should not rely solely on automated location data — in an emergency, always verbally communicate your location to emergency responders.

8. No Warranty

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Spice Holdings LLC does not warrant that the Service will be uninterrupted, timely, secure, or error-free.
